			<content:encoded><![CDATA[<p>I&#8217;ve been reading headlines and stories on Ohio State&#8217;s decision to vacate its 2010 season.  Of course, all Buckeye fans feel that this should satisfy the NCAA and the punishment should end there.  It&#8217;s amazing what little grasp of reality fans, players, coaches and administrators have.  To wit:</p>
<p>&#8220;The Buckeyes already have received their Big Ten championship rings, and athletic director Gene Smith said they won&#8217;t be recalled.&#8221;</p>
<p>&#8220;It also remains unclear whether players will receive the gold pants charms traditionally given for beating Michigan.&#8221;</p>
<p>&#8220;It&#8217;s too bad the way it&#8217;s all panned out, but in our eyes we know we played those games,&#8221; Homan said. &#8220;I will always believe we won every one of those games fairly, and I will still see us as Big Ten champs and Sugar Bowl champs.&#8221;</p>
<p>&#8220;I&#8217;ll be shocked and disappointed and on the offensive,&#8221; Gene Smith said, if the NCAA adds punishments that cause students or the school to lose money. &#8220;Unless something new arises from where we are today, it&#8217;ll be behavior (from me) you haven&#8217;t witnessed.&#8221; </p>
<p>&#8220;Besides agreeing to change his (Tressel&#8217;s) resignation to retirement, Ohio State backed off its vow to collect a $250,000 fine for violating NCAA rules. Tressel argued that he had paid enough, Elliott said.&#8221;</p>
<p>&#8220;Before his resignation, Tressel was to have been sanctioned with a five-game suspension in addition to being fined.  Instead, the university will pay him $52,250 &#8211; the equivalent of the salary and benefits he would have earned through the end of June 30th.&#8221;</p>
<p>I can&#8217;t see how the NCAA won&#8217;t blast OSU when the time comes in August. Call me an optimist but I see us winning every single game on this schedule. The period at the end of my previous sentence needs to be emphasized. I believe in our ability to go undefeated every single year due to the absolute fact that we have one of the best defenses in college football. I&#8217;ll be honest, I cringe when we&#8217;re on offense at times, but when we&#8217;re on defense, I know we&#8217;re going to shine 9 out of 10 times, and that statistic is a fact, I&#8217;ve done the research. Believing is half the battle my friends, so eliminate your doubts, look at our stellar record in years previous and have faith that history will repeat itself as it always does. We will have a great season, ban or no ban, and we will be on top as we so rightly deserve due to all the hard work put in by our amazing coaching staff and ridiculously talented players. <p>&#8220;There is no scintilla of evidence related to 90 percent of those kids listed in the Sports Illustrated article that they did anything wrong,&#8221; James said. &#8220;That&#8217;s the way it&#8217;s going to turn out, I believe. It&#8217;s just irresponsible reporting.&#8221;  Well which is it Larry?  On one hand, you claim that no scintille of evidence currently exists but in the next moment, you admit that you are merely speculating and really don&#8217;t know how it is going to turn out in the future.  </p>
<p>&#8220;For all nine, if there are 50 pieces at issue, we have 48 of them,&#8221; James said. &#8220;There might be a misplaced necklace or something, but they&#8217;re pretty much all there.&#8221;  Are you now admitting that 10% are guilty as charged and that you still account for all memorabilia?  If they still sold 2 out of 50 items, aren&#8217;t they all guilty as charged?</p>
<p>Hey Larry, when you line up every current OSU player with every piece of memorabilia ever given to each one of them along with items stolen from the equipment room and later sold then maybe I&#8217;ll believe you.  Until then, keep spreading the party line, it&#8217;s what OSU fans want to hear.</p>

			<content:encoded><![CDATA[<p>I saw the recent threats by Storm Klein&#8217;s father to bring a defamation suit against Sports Illustrated.  Barbie Carpenter on 97.1 The Fan also made reference to such threats by OSU players named in the Sports Illustrated article.  Both are complete idiots who have no understanding of the law.</p>
<p>A defense to a defamation action is that the alleged defamatory statements were made in good faith and with the reasonable belief that they were true.  Generally with newspaper reporters, who are trying to report news, they must carefully check multiple sources of the facts before printing those facts as news.  As long as they have made this effort then the statements printed are generally treated as true whether or not they really are.  Truth is a defense to a defamation action.</p>
<p>The question for Storm Klein&#8217;s father and Barbie Carpenter is whether Sports Illustrated carefully checked multiple sources prior to printing its story on numerous Ohio State football violations.  Do you ever wonder why newspapers always print, &#8220;Multiple attempts to contact Storm Klein went unanswered prior to publishing this story&#8221;?  Because it serves as part of their defense to a later defamation action.  A defendant can say that it not only carefully checked multiple sources but that it went directly to the accused and gave him a chance to respond prior to publication.</p>
<p>So idiots like Storm Klein&#8217;s father have less of a case when they get pissed off over what was printed.  </p>
<p>SI:  &#8220;Well Mr. Klein, is your son&#8217;s phone number xxx-xxxx?&#8221;</p>
<p>Mr. Klein:  &#8220;Why yes it is.&#8221;</p>
<p>SI: &#8220;And is your son&#8217;s email address sklein@osu.eud?&#8221;</p>
<p>Mr. Klein: &#8220;Why yes it is.&#8221;</p>
<p>SI: &#8220;Well we left three voicemails at that number and sent five emails to that address but your son never responded when we gave him the chance to refute what was printed.  Why are you complaining now?&#8221;</p>
<p>Even if Klein was able to show liability, he still must prove damages.  Are they going to pay some NFL draft guru $250 an hour to testify how Storm Klein&#8217;s draft status dropped from 4th round to 7th round and he lost millions of dollars as a result of the statements?  Good luck, as that is all speculation and very difficult to prove.  Last I checked, Klein&#8217;s draft status was zero anyways.  How was he damaged then?</p>

			<content:encoded><![CDATA[<p>It&#8217;s becoming more and more clear that 97.1 The Fan is the resting place for former Buckeyes who couldn&#8217;t hack it in the pros and would never be given a first look by national or even regional media outlets.  These guys are absolutely terrible on the air.  I don&#8217;t think any preparation goes into their appearances on The Fan.  Perhaps that&#8217;s why the radio station is called &#8220;The Fan&#8221; &#8211; as long as you are all rah rah Ohio State then that&#8217;s the only prerequisite.  </p>
<p>Torgerson asked Circle K what he thought of Michigan Athletic Director Dave Brandon&#8217;s comments concerning the Ohio State fiasco.  Of course, Torgerson only read a portion of those comments.  The entirety of which was -</p>
<p>&#8220;We focus on Michigan,&#8221; Brandon explained to Frank Beckmann on WJR-AM 760 Detroit. &#8220;We can&#8217;t control any of the stuff that&#8217;s going on in Columbus, or at Penn State, or at Nebraska, or any of the other programs we&#8217;re going to tee it up against this fall. We&#8217;re about focusing on Michigan.</p>
<p>&#8220;As I said, Ohio State&#8217;s gonna show up. They&#8217;ve got great athletes down there, great tradition, terrific rivalry – there will be no problem getting them up for coming up here to Ann Arbor, and playing Michigan in the Big House.&#8221;</p>
<p>&#8220;We&#8217;re gonna have to be ready and prepare like we do every year,&#8221; he said, &#8220;and we&#8217;ve gotta do a heckuva lot better than we have the last several years. This is not a time for us to be beating our chest; this is a time for us to be working hard because we&#8217;ve got to claw our way back and make our side of this rivalry much tougher than it&#8217;s been over the last few years.&#8221; </p>
<p>Circle Dumbass responded by saying that Brandon must have meant by his comments that &#8220;We don&#8217;t have any room to talk and we sucked anyways&#8221; (or words to that effect).  </p>
<p>These homers are terrible!  Brandon took the high road and Krenzel gave him zero credit.  And, by the way, Craigie, Michigan has plenty of room to talk.  Ohio State&#8217;s NCAA violations were far worse than Michigan&#8217;s and the penalties will reflect that.<br />

You&#8217;ve got to start reaching down to Florida, which I think Ohio State in the last two or three years has done well, reaching more down south and getting guys out of Florida. &#8221;</p>

<p>Illinois has 13 Florida players on their roster.</p>
<p>So I wrote Rittenberg.  Let&#8217;s see how he responds to:</p>

<p>I was reading your column, &#8220;Big Ten recruiting Q&#038;A: Part I&#8221; with expert recruiting analyst, Craig Haubert, as your guest.  In that article, Haubert lauds Ohio State for reaching down south into Florida where the players are.  He indicates that Ohio State is &#8220;adjusting the best&#8221; to going where the talent is in Florida over the last two or three years.  However a very cursory review of Big Ten rosters belies his statement.  OSU has only 7 players hailing from Florida on their current roster and 3 2011 commitments doesn&#8217;t really skew things in their favor.  Michigan has 9 on their current roster.  Illinois has 13.  Purdue has a jaw dropping 20.  I&#8217;m left wondering why I should subscribe to his &#8220;insider&#8221; reports.  Or are OSU fans more likely to open their wallet if they are pandered to then other fans?</p>
